In this Privacy Policy, we describe how we collect, use, and disclose information that we obtain about users (“Users” or “you”) of our websites (each a “Site” and collectively the “Sites”), our mobile applications (each an “App” and collectively the “Apps”), and the services available through our Sites and Apps (each a “La Madeleine Digital Platform” and collectively the “La Madeleine Digital Platforms”).

Your use of the La Madeleine Digital Platforms is also subject to our Terms of Use.

What kind of information does La Madeleine collect from Users?

Information We Collect Directly From You

We collect information directly from Users, such as when they sign up to receive special offers or information from us, sign up for our rewards programs, download franchise kits, or register for an account with us. We also collect information from Users when they submit a review, comment or other content to our Sites or Apps or on our social networking pages, and when they contact us. You can browse our Sites without registering or submitting Personal Information to us. However, to use our Apps and certain services, you must register with us or otherwise provide us with your name and other information. We may also collect information that you enter on our Sites or Apps or provide to us in any other ways, such as through email or forms on our Sites or Apps. The type of information that we collect from you depends on your interaction with us and your use of our Sites, Apps and Services, but may include:

We also collect certain information automatically through Users’ use of our Sites, Apps and Services such as what pages they are browsing and what content they are interacting with. Google Analytics

In particular, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”), on certain La Madeleine Digital Platforms. Google Analytics collects information such as how often you visit La Madeleine Digital Platforms, what pages you visit, and what other sites you visited prior to coming to our site. We use the information provided by Google Analytics to improve La Madeleine Digital Platforms. We will process your request as soon as possible in accordance with applicable law, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe is processed.

Generally, users cannot opt out of these communications, but they will be primarily informational in nature, rather than promotional.

Security Statement

We seek to keep your Personal Information secure and implement reasonable technical, administrative, and physical safeguards to help us protect such information from unauthorized access, use, and disclosure. We also request that our third-party service providers use commercially reasonable security measures to protect your information from unauthorized access or use. Plug-ins and Social Media

The La Madeleine Digital Platforms may include social networking features and widgets, such as the Facebook “Like” button and the “Share this” button, as well as other interactive mini-programs that run on our platforms. These features may collect your IP address, which page you are visiting on our Sites, and may set a cookie to enable the feature to function properly. These features are displayed on our platforms, but are hosted by third parties, and are subject to their own privacy policies, not this Policy. Your interactions with these features are governed by the privacy policy of the company providing them.

Third-Party Links

The La Madeleine Digital Platforms may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Privacy Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the privacy practices of such third-party websites.

Children’s Privacy

La Madeleine does not knowingly collect information about children under the age of 13. In the event that we receive actual knowledge that we have collected Personal Information from a child under the age of 13, we will delete that information from our database as quickly as is practical. Please contact us via the Contact Information provided below if you believe we may have collected such information, and we will work to remove it.

Third-Party Hosting

We contract with one or more third parties to maintain and host our la Madeleine Digital Platforms. Therefore, any information you submit, including Personal Information, shall be placed and stored on a computer server maintained by this third party. Your use of the La Madeleine Digital Platforms and any provision of Personal Information you submit to the La Madeleine Digital Platforms constitute your acknowledgement that such information or content could pass through and may be stored in servers outside the control of la Madeleine. La Madeleine has no liability or responsibility for any such pass-through or storage of same.

International Data Transfers

We are based in the US. If you choose to provide us with information, please understand that your Personal Information may be transferred to the US and that we may transfer that information to our affiliates and subsidiaries or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the European Union (“EU”) or other regions with laws governing data collection and use that may differ from US law, please note that you are transferring your Personal Information to the US and other jurisdictions which may not have the same data protection laws as the EU. You acknowledge you understand that by providing your Personal Information: (i) your Personal Information will be used as identified above in accordance with this Privacy Policy; and (ii) your Personal Information may be transferred to the US and other jurisdictions as indicated above, in accordance with applicable law.

Assignment

In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personal information collected via the La Madeleine Digital Platforms.

Dispute Resolution and Agreement To Arbitrate

Except where and to the extent prohibited by law, by using the Sites, you and we agree that, if there is any controversy, claim, action, or dispute arising out of or related to your use of the La Madeleine Digital Platforms or the breach, enforcement, interpretation, or validity of this Privacy Policy or any part of it (“Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party thirty (30) days in which to respond to or settle the Dispute. Notice shall be sent to:

Both you and we agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR SUCH DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. Other rights that you and we would otherwise have in court will not be available or will be more limited in arbitration, including discovery and appeal rights. All such disputes shall be exclusively submitted to JAMS (www.jamsadr.com) for binding arbitration under its rules then in effect, before one arbitrator to be mutually agreed upon by both parties.

The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising under or relating to the interpretation, applicability, enforceability, or formation of this Privacy Policy, including any claim that all or any part of this Privacy Policy is void or voidable.

Choice Of Law

This Privacy Policy has been made in and shall be construed in accordance with the laws of the State of Texas, without giving effect to any conflict of law principles. Any disputes or claims not subject to the arbitration provision discussed above shall be resolved by a court located in the State of Texas and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

How We Respond To “Do Not Track” Signals

At this time our Sites do not recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.

Your California Privacy Rights

California residents may request a list of certain third parties to which we have disclosed Personal Information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for our response. Changes To This Privacy Policy

We may revise this Privacy Policy from time to time effective upon posting the revised Privacy Policy, along with the date on which it was most recently updated, on the Sites. Please check our Privacy Policy periodically to see if it has been updated. If a change to this Privacy Policy materially affects the use or disclosure of your Personal Information, a notice will be posted on www.lamadeleine.com along with a link to the updated Privacy Policy. Your continued use of la Madeleine Digital Platforms and/or provision of your information thereafter constitute your acceptance of such changes.
